Acceptance of these terms
By creating an account or otherwise using the Stubwise mobile app ("Stubwise," "the app," "we," "us"), you agree to these Terms of Use. If you don't agree with them, please don't create an account or use the app.
These terms are between you and O Gravata Consulting LLC, a Florida limited liability company, which develops and operates Stubwise.
What Stubwise is
Stubwise helps hourly workers check whether a paycheck matches the hours they worked, using overtime and minimum-wage rules built from federal law (FLSA) and the state rules the app supports. You log your shifts (or clock in and out), tell the app what your actual paycheck said, and Stubwise shows you the gap, if there is one.
Stubwise is a calculator and an alert, not a certified payroll audit, not a substitute for professional accounting or legal advice, and not a guarantee of accuracy for every possible pay situation, employer policy, or local ordinance. See Section 8 for the full disclaimer.
Eligibility
Stubwise is intended for people old enough to be legally employed and paid on an hourly basis in their jurisdiction, and is not directed at children under 13. By creating an account, you confirm that you meet that bar.
Your account
Using Stubwise requires an account (an email address and a password), so your pay data can be backed up and restored if you switch phones. You agree to:
- Provide an email address you actually control, so you can be reached about your account if needed.
- Keep your password confidential, and let us know at contact@stubwise.app if you believe your account has been accessed without your permission.
- Use one account per person — Stubwise's pay calculations are built around a single person's rate history and shifts.
You can log out at any time without losing your backup, or permanently delete your account and everything backed up to it from the Me tab inside the app. Deletion is immediate and cannot be undone.
Acceptable use
You agree not to:
- Use Stubwise for any unlawful purpose, or in a way that violates any applicable law or regulation.
- Attempt to gain unauthorized access to another user's account or to Stubwise's servers or infrastructure.
- Reverse engineer, decompile, or attempt to extract the source code of the app, except where applicable law expressly permits it despite this restriction.
- Interfere with or disrupt the integrity or performance of the app or the server it talks to (for example, by attempting to overload it or bypass its rate limits).
We may suspend or terminate an account that we reasonably believe violates this section — see Section 10.
Fees
Stubwise is currently free to use while the app is in testing. If that changes in the future — for example, if we introduce a paid subscription tier — we'll tell you clearly in the app before you're ever charged, and nothing about your existing account or backed-up data will be held hostage to that change.
Your data
What Stubwise collects, why, and how it's stored and protected is covered in full in our Privacy Policy, which is incorporated into these Terms of Use by reference. In short: we collect only what's needed to run the app and back up your pay data, we don't sell or share it with advertisers, and you can delete it permanently at any time.
Disclaimer of warranties
Stubwise's overtime and minimum-wage calculations are built from federal and state wage-and-hour rules as understood at the time the app was built. Laws change, employer policies vary, and no calculator can account for every circumstance. For an actual dispute with an employer, talk to your state labor department or an employment attorney — don't rely on Stubwise alone.
Stubwise is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including — to the extent permitted by law — implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the app will be uninterrupted, error-free, or that its calculations will be accurate for every jurisdiction, employer, or pay situation.
Limitation of liability
To the fullest extent permitted by applicable law, O Gravata Consulting LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of wages, profits, or data, arising out of or related to your use of Stubwise — including reliance on any calculation the app produces. Some jurisdictions don't allow the exclusion of certain warranties or limitation of liability, so some of these limits may not apply to you.
Termination
You can stop using Stubwise and delete your account at any time from inside the app — see Section 4. We may suspend or terminate an account that violates Section 5 (Acceptable use), or that we're required to act on by law, with notice where reasonably practical. If we terminate your account for cause, we may retain the minimum information necessary to comply with legal obligations, but your pay data backup will be deleted the same way it would be if you deleted the account yourself.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, except where applicable consumer-protection law in your own jurisdiction requires otherwise.
Changes to these terms
If these terms change, we'll update the effective date above and describe the change plainly, in this same document, before that version reaches you. We won't backdate a change or bury it in dense language you'd need a lawyer to unpack; that's the opposite of what this app is for. Continuing to use Stubwise after a change takes effect means you accept the updated terms.
